Welcome to moderntribes AG ("moderntribes", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of our website located at moderntribes.world and our DeFi risk assessment services (collectively, the "Service").

moderntribes provides specialised DeFi (Decentralised Finance) risk assessment services for institutional investors. Our services include but are not limited to:

• Protocol security analysis and smart contract audits
• Liquidity risk assessment and market depth analysis
• Regulatory compliance guidance for DeFi investments
• Portfolio risk modelling and optimisation
• Real-time monitoring and risk alerts
• Expert advisory and consultation services

All services are provided on a professional basis to institutional clients and are subject to separate service agreements.

User Obligations

By using our Service, you agree to:

• Regulatory frameworks for DeFi are evolving and may change

You agree to make investment decisions based on your own analysis and risk tolerance, and moderntribes shall not be responsible for any investment losses you may incur.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall moderntribes AG, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

In no event shall moderntribes' total liability to you for all damages, losses, or causes of action exceed the amount you have paid moderntribes in the twelve (12) months prior to the event giving rise to the liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for consequential or incidental damages. Accordingly, some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless moderntribes AG and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service caused damage to a third party.

Governing Law

These Terms shall be interpreted and governed by the laws of Austria, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Austria, and you hereby consent to personal jurisdiction and venue therein.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your use of the Service at any time by discontinuing your use of the website and any related services.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination.

Severability

The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and moderntribes concerning the Service and supersede all prior or contemporaneous communications and proposals between you and moderntribes.
